Contact Schedule A — Apple devicesBy downloading, accessing, or using Matchside (the "App"), you agree to these Terms of Use and to our Privacy Policy. If you don't agree, don't use the App.
You must be at least 13 years old to create an account and use the App. Matchside is for players, parents, coaches, and fans aged 13 and up. By using the App you represent that you are 13 or older. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf. Matchside is not intended for children under 13, and they may not create or use accounts.
Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse-engineer, resell, or distribute the App except as allowed by law.
You're responsible for your account and for keeping your sign-in secure. You're responsible for activity that happens under your account. Tell us promptly if you believe your account has been compromised.
Scoring matches, your full match statistics, your match history and player archive, share codes, the live box score, and watching any broadcast that has already been produced are free — for everyone, with no time limit. We charge for producing new AI broadcasts, and for the fan features described below. We don't charge you to keep or reach your own data.
Producing an AI broadcast costs a credit. Credits are a limited, revocable license to use a feature of the App — they are not money, have no cash value, are not a stored-value or gift-card product, cannot be redeemed for cash, and cannot be sold, transferred, or moved between accounts.
Passes grant a fixed number of credits that are valid for a stated window from first use. A pass is a one-time purchase — it does not renew, and it does not convert to a subscription. When the window closes, any remaining credits expire.
Matchside offers auto-renewing subscriptions. The plan name, the exact price in your local currency, the billing period, and what's included are shown in the App on the purchase screen before you buy, and they control. In summary:
Please read the following carefully — it is how auto-renewal works:
All purchases in the App are processed by Apple, not by us. We never see or store your payment-card details. Because Apple is the merchant of record, refund requests are handled by Apple — request one at reportaproblem.apple.com. Except where the law requires otherwise, purchases are final and credits are non-refundable, including credits spent on a broadcast that was produced. If something went wrong on our end — a broadcast failed to generate, or a credit was drawn without producing anything — email us at hello@foundryforty1.com and we will restore the credit.
We may change prices. A price change to an auto-renewing subscription applies only to future periods, and Apple will notify you and, where required, ask you to consent before the change takes effect. If you don't agree, cancel before the next renewal.
If you're a consumer in the EU, UK, or another jurisdiction with statutory withdrawal or cancellation rights, nothing here limits those rights.
Matchside lets you create player profiles and score matches, which may include information about other people — including your own minor child and opponents. You represent and warrant that you have the right and any necessary consent to provide that information, and that your use complies with applicable law. You are responsible for the accuracy of what you enter and for how you share the broadcasts you create. If you enter information about a minor, you confirm you are that child's parent or legal guardian, or are otherwise authorized to do so.
You agree not to:
We may remove content or suspend accounts that violate these terms or that we reasonably believe harm others.
You keep ownership of the match data and player information you create ("Your Content"). You grant us the limited license needed to host, process, and display Your Content to operate the App — including generating broadcasts, commentary, highlights, and stats, and showing them to people you share a link with. When you share a broadcast link, you're choosing to let its recipients view that broadcast.
The App itself — its software, the Matchside name and logo, the broadcast renderer, the commentary system, and the site — is owned by Foundry Forty1 LLC and protected by intellectual-property laws. These terms don't give you any rights in our brand or technology except the limited license to use the App.
Matchside relies on third-party services (such as Apple, Google, and our hosting and AI providers) to work. Your use of those services through the App may also be subject to their terms. We're not responsible for third-party services we don't control.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Broadcasts, commentary, and stats are generated automatically from your scoring and may contain errors; they are for entertainment and personal record-keeping, not official results. We don't warrant that the App will be uninterrupted, error-free, or that data will never be lost — keep your own records of anything important.
To the fullest extent permitted by law, Foundry Forty1 LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim, or US $50.
You agree to indemnify and hold harmless Foundry Forty1 LLC from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the App, Your Content, your violation of these terms, or your violation of anyone's rights — including any claim relating to information you entered about another person.
You may stop using the App and delete your account at any time from Settings › Delete account in the app. Deletion is immediate and permanent, and it forfeits any unused credits and cancels nothing on Apple's side — if you have a subscription, cancel it separately in your Apple Account settings (see Section 5), or it will keep renewing. See the Privacy Policy for exactly what is erased. We may suspend or terminate your access if you violate these terms or to protect the service or other users. Sections that by their nature should survive termination (such as ownership, disclaimers, liability limits, and indemnity) will survive.
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where applicable law provides otherwise.
We may update these terms as the App evolves. When we make a material change, we'll update the date above and, where appropriate, notify you in the App. Continuing to use Matchside after an update means you accept the revised terms.
